1. ACCEPTANCE OF TERMS
By using i3TEAMWORKS “Service”, which is developed and maintained by M3 Online Sdn. Bhd. (853112-M) ("M3 Online") and its subsidiaries, you agree to be bound by the following Terms of Service ("TOS") set by M3 Online. The TOS is subject to change according to M3 Online Management’s discretion and may be updated by us from time to time without prior notice.
2. DEFINITIONS OF SERVICE
You understand and agree that our current Service changes, features and enhancements shall be subjected to the TOS. Our Service is provided "as it is". Should the user accidentally delete or amend details on their own accord, our Service assumes no responsibility for the deletion, mis-delivery or failure to store the user’s accidental content or settings’ amendments.
You are responsible for the payment of fees in order to use our Service and obtain access to it, which in particularly addresses the Internet Service Provider charges. In addition, you must provide all equipment necessary to access the Service and are responsible for it.
3. USE OF SERVICE
By using the Service, you have agreed to ensure that the usage of the Service will comply with all applicable laws, ordinances, codes, rules, regulations, notices, instructions or directives of the relevant authorities or with any notices given by M3 Online in connection with M3 Online Services. Such applicable laws or regulations shall include but not be limited to those relating to subversive, defamatory, obscene or pornographic materials, or other content standards or breach of copyright, patent or other proprietary rights, or in a manner which in the reasonable opinion of M3 Online may adversely affect the use of the Services by other users of M3 Online that pertains to the efficiency of the System or M3 Online Service as a whole.
4. INVOICING AND PAYMENT
M3 Online reserves the right to invoice you in correspondence to your Service subscription plan. M3 Online will notify you via email within 30 days prior to the end of your subscription plan. Upon receiving our email notice, you can either continue using the Service, hence allow M3Online to renew your existing subscription plan for you to make payment, or you can upgrade or cancel your subscription plan. All payment shall be Payable to "M3 Online Sdn. Bhd.".
Please note that the Growing Team (priced currently at RM 188/month), Large Team (priced currently at RM 488/month) and Enterprise (priced currently at RM999/month) packages will end its offer on 31st July 2016. Prices stated here are subject to change without prior notice according to the discretion of M3 Online Management.
M3 Online reserves the right to change the Free Trial time period at its own discretion. All Free Trial registered users will receive an email notification from M3 Online regarding any new changes. Please refer to item No. 9 for further information about notice.
5. PRIVACY POLICY - ACCOUNT, PASSWORD & SECURITY
All written / visual information of any kind, whether printed or electronic format, including but not limited to technical information, data, know-how and information relating to either Party's (or its respective holding, related or subsidiary companies') business, marketing strategies, financial condition and operations whether or not labelled as "Confidential" and submitted by one Party to the other shall be categorised as “Confidential Information”.
6. INDEMINITY
You agree to indemnify and hold M3 Online, its subsidiaries, affiliates, officers, agents, co-branders, partners and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your Content submissions, posts, transmissions or availability through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.
7. DECLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IT IS" AND "AS AVAILABLE" BASIS. M3 ONLINE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
1. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL
2. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM M3 ONLINE OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.
8. EXCLUSION AND LIMITATIONS
M3 ONLINE’S JURISDICTIONS DOES NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
9. NOTICE
Customers who have subscribed and paid for M3 Online’s Service will be notified via email regarding any changes to our current Service and TOS.
M3 Online reserves the rights to advertise to all registered users via email marketing from time to time our other services, current promotions (if any), marketing materials and newsletters.
10. COPYRIGHTS AND VIOLATIONS
M3 Online respects the intellectual property of other parties, and we ask our users to pay the same courtesy. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please contact M3 Online and report the violations of the TOS to us.
